Decision on where to incorporate
The ASIC information explains 2 ways of incorporating a non-for-profit foundation:
- a company structure
- an incorporated association
Registration as a public company requires a registered office address that is accessible to the public, an appointed auditor and annual audits, an annual review with a review fee of $1000 ($40 if we get "special purpose" status). We have the full legal oblications of a company.
Incorporation as an Associations can only be done under state authorities, not federally. This implies that associations can only "carry on business" in the registered state.
ASIC suggests that small, community based groups with limited resources should incorporate an associations because it is simpler and more affordable.
